The Free Speech Union says newly released Official Information Act documents raise serious questions about the Government's direction on digital identity and online age verification. The organisation argues New Zealanders deserve an open parliamentary debate before any system requiring adults to verify their identity online is introduced.

Documents released to the Free Speech Union under the Official Information Act show the Department of Internal Affairs (DIA) considering the digital Kiwi Access Card—the modern successor to the 18+ card—as a potential tool for online social media age verification.
According to the Free Speech Union, a February 2026 briefing prepared for Minister of Education Hon Erica Stanford states that the digital Kiwi Access Card "could also be used for online age verification if the government were to introduce requirements for social media platforms to require age assurance." The briefing also notes the card is being developed using the Government's digital wallet and NZ Verify applications.
Free Speech Union Chief Executive Jillaine Heather said there is an important distinction between voluntary identification and mandatory identity verification for access to lawful online content.
"There is a vast difference between digital ID as a convenience at the bar door and requiring every New Zealander to verify their identity prior to accessing lawful speech. Crucially, Parliament has never voted on any of it."
Heather said age verification proposals would extend well beyond young people.
"To keep under-16s out, every adult must prove their age," she said, arguing that the Privacy Commissioner has acknowledged this consequence while DIA continues preparing the underlying infrastructure.
Communications strategy questioned
The released documents also include a communications package titled Key Messages on Digital Identity, which states its purpose is to "mitigate concerns on any misuse of digital ID as part of the minimum age proposals."
According to the documents, ministerial talking points include the statement:
"It is important that the public understands that the Trust Framework is not a government ID scheme."
Heather said those communications raise further questions about the Government's intentions.
"When a government department writes a script to stop you seeing mandatory age-gating, and a digital ID scheme for what it is, that tells you the department knows exactly what it is."
She argued that Parliament has yet to determine whether adults should be required to identify themselves before accessing lawful online content.
"Parliament has not decided whether adults must identify themselves before reading lawful content online. That is the whole question, and DIA is answering it with procurement contracts and talking points instead of a vote."
Heather said New Zealanders should have the opportunity to examine the proposals before any permanent digital identity infrastructure becomes established.
"New Zealanders are entitled to know what DIA is building before the surveillance infrastructure is embedded, because once it is built, no government will take it down."
Documents released under the Official Information Act
The Free Speech Union said the documents were released on 14 July 2026 under Official Information Act request OIA 2526-1378.
Among the material cited are:
- A briefing to Hon Erica Stanford dated 26 February 2026 discussing the potential use of the digital Kiwi Access Card for online age verification.
- Internal "Key Messages on Digital Identity" prepared to address public concerns surrounding digital identity proposals.
- Ministerial talking points emphasising that the Trust Framework is not a government ID scheme.
- DIA correspondence withholding nine of fourteen requested documents under provisions of the Official Information Act while matters remain under ministerial consideration.
- Information confirming the digital Kiwi Access Card is being developed by Hospitality New Zealand and NEC New Zealand using the Government's Govt.nz wallet and NZ Verify applications under the Digital Identity Services Trust Framework.
